i-Star TERMS OF PURCHASE
The Terms of Purchase contain the terms and conditions upon which We may agree to sell goods and/or services contained on this Web Site to You. Where We enter into a contract(s) with You for the sale of such goods and/or services to You, then (in the event of any inconsistency between these Terms of Access and the Terms of Purchase) those Terms of Purchase shall take precedence.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
Subject to above, Philex will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error–free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website Philex will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and Philex accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
Subject to Section above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.
Subject to Section above, Philex will not be liable, in contract, tort (including, without limitation, negligence), pre–contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
loss of goodwill or reputation; or
special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
Notwithstanding the above, subject to other relevant law Philex' aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
This clause does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
Philex shall not be liable to the Customer or deemed to be in breach of Contract by reason of any delay in performing, or any failure to perform, any obligations of Philex in relation to the Goods, provided that the delay or failure was due to any cause beyond reasonable control of Philex. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control of Philex: Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Philex or of a third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery.
The price of any Goods will be as quoted on This Site (including the Agent's Microsites) from time to time, except in cases of obvious error. These prices include VAT but exclude delivery costs.
Prices are liable to change at any time, but changes will not affect orders that are the subject of a Sale Confirmation.
This Site contains a large number of Goods and it is always possible that, despite our best efforts, some of the Goods listed may be incorrectly priced. Prices will normally be verified as part of the dispatch procedures so that, where the correct price is less than the stated price, you will be charged the lower amount. If the correct price is higher than the stated price you will be contacted for instructions before dispatching the Goods and you may then cancel your order if you wish. If you do not cancel your order the Goods will be supplied at the higher price. We are under no obligation to provide Goods to you at the incorrect (lower) price, even after we have sent you a Sale Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
You may pay for Goods ordered by any of the payment options available on This Site or the Agent's Microsite through which you order the Goods.
Credit or debit cards will not normally be charged until the Sale Confirmation has been issued.
You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks by the card issuer.
All payments must be in UK Pounds.
Goods will be at your risk from the time of delivery. Ownership of Goods will only pass to you when we or one of our Agents receive full payment of all sums due for the Goods, including any applicable delivery charges.
If you wish to buy Goods through This Site then you should follow the procedure specified in This Site or if applicable the Agent's Microsite through which you make your purchase.
After placing an order, you will receive an e-mail acknowledging that your order has been received. Please note that this does not mean that your order has been accepted. Your order is an offer to buy Goods from us and all orders are subject to acceptance. Acceptance of your order will be by an e-mail from us or an Agent (the Sale Confirmation) that confirms that the Goods you have ordered are available for dispatch.
The contract between you and us (the Contract) will only be formed when a Sale Confirmation is sent to you.
The Contract relates only to those Goods whose availability for dispatch is confirmed in the Sale Confirmation. Neither we nor any Agent is obliged to supply any Goods which may have been part of your order until the availability for dispatch of such Goods has been confirmed in a Sale Confirmation.
You will be informed as soon as possible if for any reason Goods ordered by you are not available for supply. Where you have already paid for the Goods, you will then be issued with a full refund.

• Products can be returned to i-Star for a refund if the product was purchased from our website and it is returned in its unopened original packaging within 7 Days from date of purchase.
• Products that are opened and used can only be returned if they are broken or defective and they meet our warranty policy guidelines.
Faulty goods: if the item appears faulty within 28 days of receipt you will need to return it to us so that we can process the request and if appropriate send a replacement or issue a refund to you or investigate further if deemed necessary.
If the product is over 28 Days but under 12 Months, please return it to us so we can inspect and accordingly repair or replace the item as appropriate with the same / or similar product model.

• i-Star does not offer full refunds for opened products that are not deemed to be faulty.
• In the case you receive something other than what you ordered due to a shipping error, we will gladly exchange that product for the correct item and pay for additional shipping as long as it was purchased directly from our website and it is returned in its unopened original packaging.
• If the incorrect order placed was due to user error (i.e. ordering the wrong colour or product by accident), we will do an exchange* as long as the product was purchased from our website and it is returned in its unopened original plastic packaging.
*Customer will be responsible for the shipping charges
• If you have bought one of our products from another retailer and the product is faulty, please contact the Retailer directly in the first instance to resolve your problem.
NOTE: Full warranty rights are limited to the original owner of a new, packaged
i-Star product purchased from an authorized reseller who registered their item and activated their full warranty within the specified period in the prescribed manner. Items purchased second-hand or used are not covered by the i-Star warranty. You may only submit one product per warranty claim. Any suspected fraudulent behaviour will be marked as requiring further clarification and will be investigated by
i-Star before approving your warranty. Contact the i-Star Customer Service team if you have any questions.
